I — Introduction

By accessing and using the website www.mudelar.pt (hereinafter, the "Website"), the User declares that they have read, understood and agree to be bound by these Terms and Conditions of Use and this Privacy and Data Protection Policy, drawn up in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council, of 27 April 2016 (General Data Protection Regulation — GDPR) and applicable national legislation.

If you do not agree with these conditions, you should refrain from accessing, browsing or entering data on the Website. Continued use of the Website after the publication of updates to this document shall constitute acceptance of the updated versions.

II — Purpose and Scope

The Website aims to provide information about renovation services, scheduling of technical visits, collection of quote requests, presentation of project examples and communication with Clients and Interested Parties. These Terms govern access to and use of the Website by any User, including those who publish, send or share content therein (e.g., forms, comments, contact requests).

III — Conditions of Use

  • The User agrees to use the Website diligently, responsibly and in compliance with the law.
  • It is prohibited to carry out unlawful, offensive, defamatory, abusive, fraudulent acts or acts that disturb the normal functioning of the Website.
  • Without limiting the above, the User may not:
    • (a) make available illegal content or content that infringes the rights of third parties;
    • (b) impersonate third parties or misrepresent themselves;
    • (c) introduce viruses, malware, worms or other malicious code;
    • (d) attempt to access areas, systems or data without authorization;
    • (e) use the source code, design, layout or any components of the Website for competitive purposes, including the creation of competing tools or services.

M1D3L4R makes reasonable efforts to ensure the accuracy and currency of the content, but does not guarantee its completeness, assuming no responsibility for typographical errors, omissions, service interruptions, technical or computer failures. Any errors detected will be corrected within a reasonable timeframe.

The Website may contain links to third-party websites. M1D3L4R does not control and is not responsible for their content, privacy policies or practices. Careful reading of the terms and policies of such websites before use is recommended.

V — Changes to the Website and These Terms

M1D3L4R reserves the right, at any time and without prior notice, to modify the presentation, structure, features or content of the Website, as well as these Terms and the Privacy Policy, subject to rights acquired in contracts already entered into and in execution. Use of the Website after the publication of changes implies acceptance thereof.

VI — Intellectual Property

Unless otherwise indicated, all elements of the Website (trademarks, logos, trade names, texts, photographs, videos, illustrations, layout and design) are the property of M1D3L4R or are duly licensed. The reproduction, modification, distribution, public communication, extraction or reuse, in whole or in part, by any means, without prior written authorization from M1D3L4R, is prohibited.

M1D3L4R applies appropriate technical and organizational measures to protect data and systems (for example, pseudonymization, encryption in transit, access control, backups and regular testing). However, the User acknowledges that no system is completely inviolable and that the use of the Internet entails inherent risks.

  • (a) use or inability to use the Website;
  • (b) substitution of goods/services resulting from communications or transactions made through the Website;
  • (c) unauthorized access, alteration or destruction of content or personal data;

IX — Privacy and Data Protection Policy (GDPR)

1. Data Controller

M1D3L4R, REMODELAÇÕES, UNIPESSOAL, LDA, NIPC 516617184, headquartered at Rua da Liberdade 132 B, 1675-043 Pontinha, is the entity responsible for the processing of personal data collected through the Website and associated contact channels (geral@mudelar.pt and phone (+351) 21 248 22 61).

2. Categories of Data Processed

  • Identification and contact: name, email, phone/mobile, address, postal code.
  • Project/commercial data: type of renovation, measurements/plans, preferences, budget, preferred payment method, availability for contact.
  • Technical browsing data: IP address, device and browser characteristics, date/time, pages visited, referrer, cookies and online identifiers (see Cookie Policy).
  • Communications: content exchanged via forms, email or phone, including support and quality records.

3. Purposes and Legal Bases

Personal data may be processed for the following purposes and legal bases (Art. 6(1) GDPR):

  • Quotation, visit scheduling and pre-contractual/contractual performance — (b): processing requests, preparing proposals, scheduling and monitoring works.
  • Administrative, accounting and tax management — (c): compliance with legal obligations.
  • Commercial follow-up communications (order tracking, satisfaction, improvements) — (f): legitimate interest in commercial activity, weighing the rights of the data subject.
  • Direct marketing (newsletters, campaigns, invitations) — (a): data subject's consent, when applicable; consent is free, specific, informed and may be withdrawn at any time.
  • Security and fraud prevention — (f): monitoring and auditing access and traffic.
  • Dispute management and exercise of rights — (f) and (c): defence of interests and compliance with legal obligations.

4. Data Origin

Data is provided by the User (forms, email, phone), generated by Website use (technical data) or obtained from providers acting on behalf of M1D3L4R (subcontractors) in strict compliance with the instructions given.

5. Retention Periods

  • Commercial/proposals: up to 2 years after last useful contact, unless objected to or subject to a different legal obligation.
  • Contractual and billing: for the applicable legal period (generally 10 years).
  • Consented marketing: until withdrawal of consent or exercise of the right to object.
  • Logs and security: up to 12 months, unless a longer period is needed for incident investigation.

6. Recipients and Subcontractors

M1D3L4R may engage service providers (e.g., hosting, email, CRM, billing, accounting, IT, logistics) who will process data on its behalf and instructions, under contracts that ensure confidentiality, security and GDPR compliance. In specific circumstances, data may be communicated to public authorities (tax authority, courts, police forces) by legal obligation.

7. International Transfers

Whenever data is transferred to countries outside the EEA, M1D3L4R will ensure an adequacy basis (Art. 45 GDPR) or, in its absence, the execution of Standard Contractual Clauses (Art. 46) and relevant impact assessments, implementing additional safeguards when necessary.

8. Data Subject Rights

Under Arts. 12 to 22 of the GDPR, the data subject has the rights of access, rectification, erasure, restriction, portability, objection and the right not to be subject to exclusively automated decisions. To exercise these, contact administrativo@mudelar.pt or by post to the registered address. The request will be processed within the legal deadline, subject to justified exceptions.

Marketing and communications: you may, at any time, unsubscribe from any communication by sending an email to administrativo@mudelar.pt.

If you consider that the processing violates applicable legislation, you may file a complaint with the National Data Protection Commission (CNPD) at www.cnpd.pt.

9. Security Measures

  • Access controls, profiles and activity logs (audit logs);
  • Encryption of communications (HTTPS/TLS) and pseudonymization when applicable;
  • Backups and business continuity and recovery plans;
  • Data retention and secure deletion policies;
  • Training and confidentiality obligations for employees and service providers.

10. Necessity of Data Provision

The provision of data marked as mandatory is necessary to process requests and enter into/execute contracts. Omission or inaccuracy prevents the adequate provision of services.

These Terms are governed by Portuguese law and the GDPR. In case of dispute related to the use of the Website or data protection, and without prejudice to applicable alternative dispute resolution mechanisms, the Portuguese courts shall have jurisdiction under general terms.

XIII — Alternative Consumer Dispute Resolution
